1. Who we are
9th Avenue is a solo-founded web development studio based in Port Arthur, Texas, United States, operated by Carlos Gonzalez. For privacy questions, contact info@9thavenue.dev.
2. Information we collect
We collect the following categories of information:
- Contact information you provide. Name, email address, phone number, company name, and any details you include when submitting a contact form, requesting a quote, or replying to our communications.
- Project information you provide. Project requirements, budget ranges, timelines, files, screenshots, and any other materials you share to scope or deliver work.
- Usage information. IP address, browser type and version, device type, referring URL, pages visited, time on page, and other standard server-log information automatically logged when you visit the website.
- Coarse geolocation. Country, region, and city inferred from your IP address by our hosting provider (Cloudflare). Used to personalize headlines and city lists on marketing pages. We do not collect precise GPS location.
- Authentication information. If you sign in via a third-party identity provider (Google, GitHub, Apple), we receive your name, email address, and profile picture as authorized by the provider. We do not receive or store your password for that provider.
3. Information from Google services
If you grant 9th Avenue access to a Google account (for example, to authorize Google Search Console or Google Analytics data pulls), we receive only the scopes you explicitly approve through the standard Google OAuth consent screen. We use that access solely for the purpose disclosed at the time of consent, do not sell or transfer the data, do not use it for advertising, and revoke our stored credentials when you ask us to or when the engagement ends. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
4. How we use information
We use the information we collect to:
- Respond to inquiries and provide consultations.
- Scope, deliver, and support client projects.
- Send transactional communications about active engagements.
- Operate, secure, and improve the website and our services.
- Generate aggregate, non-identifying analytics about usage.
- Comply with legal obligations and enforce our agreements.
We do not use your information for behavioral advertising and we do not sell your personal information.
5. Legal bases (EEA and UK visitors)
Where the General Data Protection Regulation or UK GDPR applies, our legal bases for processing are: (a) your consent, where you have given it; (b) our legitimate interests in operating the business, securing the site, and responding to your inquiries; and (c) compliance with legal obligations.
6. Cookies and similar technologies
The9thave.com uses a minimal set of cookies and similar technologies, including session cookies for form submissions, Cloudflare security cookies, and privacy-respecting analytics cookies. We do not use third-party advertising cookies. You can control cookies through your browser settings; blocking cookies may affect site functionality.
7. How we share information
We do not sell personal information. We share information only with the following categories of recipients and only as needed:
- Service providers we rely on to operate. Cloudflare (hosting, CDN, security), AWS Simple Email Service and Resend (transactional email), Vercel (preview hosting on some projects), Sentry or Better Stack (error monitoring), and analytics providers configured per project.
- Professional advisors. Lawyers, accountants, and auditors when required for compliance or to enforce our rights.
- Law enforcement or government authorities. When required by valid legal process or to protect the safety of users or the public.
- Successors. If 9th Avenue is involved in a merger, acquisition, or asset sale, information may transfer to the successor entity, subject to this Privacy Policy.
8. Data retention
We retain inquiry information for up to 24 months after the last interaction. Active project files and communications are retained for the duration of the engagement plus 7 years for tax and legal compliance, unless a shorter retention is required by law or contract. Server logs are retained for 30 to 90 days.
9. Security
We use industry-standard safeguards including TLS encryption in transit, encryption at rest for stored data, access controls, and the principle of least privilege. No method of transmission or storage is perfectly secure; we cannot guarantee absolute security.
10. International transfers
We operate from the United States. If you access the site or send us information from outside the United States, your information will be processed in the United States and other jurisdictions where our service providers operate.
11. Your rights
Depending on your location, you may have the right to access, correct, delete, port, or restrict processing of your personal information, and to withdraw consent at any time. To exercise these rights, email info@9thavenue.dev from the email address associated with your information. We may need to verify your identity before fulfilling the request.
California residents have specific rights under the California Consumer Privacy Act, including the right to know, the right to delete, the right to correct, and the right to opt out of sale or sharing (we do not sell or share personal information for cross-context behavioral advertising).
12. Children's privacy
Our services are not directed to children under the age of 13 (or 16 in the EEA / UK). We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.
